1. About Bespoke Mysteries

Bespoke Mysteries LLC ("Bespoke Mysteries," "we," "us," or "our") is a luxury immersive entertainment company operating in the Dallas-Fort Worth Metroplex, Texas. We provide custom, in-home mystery experience services for private clients, corporate groups, and special events.

These Terms of Service govern your use of our website at bespokemysteries.com and any service agreements you enter into with us.

2. Consultation Requests

Submitting a consultation request through our website does not constitute a contract or binding agreement. It is an expression of interest that allows our team to contact you to discuss your needs.

All consultations are complimentary and completely confidential. We will not share information disclosed during a consultation without your express permission.

We reserve the right to decline any enquiry at our sole discretion.

3. Service Agreements and Booking

Our services are provided pursuant to a separate written Service Agreement executed between Bespoke Mysteries and the client ("Client"). The Service Agreement will set forth the specific terms for your event, including:

• A detailed description of the services to be provided
• The agreed event date, time, and venue
• Total fees and payment schedule
• Deposit requirements and cancellation terms
• Any special conditions or customisations agreed upon

In the event of any conflict between these Terms of Service and your individual Service Agreement, the terms of your Service Agreement shall prevail.

4. Fees and Payment

All pricing displayed on our website represents estimated ranges and is provided for informational purposes only. Final pricing is determined based on the scope of your event, venue complexity, number of guests, and other factors discussed during your consultation.

Payment terms, including deposit amounts and due dates, will be specified in your Service Agreement. We typically require:

• A non-refundable deposit to confirm your booking and commence creative development
• Interim payments as outlined in your Service Agreement
• Full payment prior to the event date, unless otherwise agreed in writing

All fees are quoted in US Dollars. Applicable sales tax will be applied where required by Texas law.

5. Cancellation and Rescheduling

Cancellation and rescheduling terms will be specified in your Service Agreement. As a general guideline:

• Cancellations made more than 60 days before the event date may be eligible for a partial refund of payments made beyond the non-refundable deposit
• Cancellations made within 60 days of the event date may result in forfeiture of all fees paid, as our team will have invested significant creative and logistical resources
• Rescheduling requests are accommodated where possible and subject to availability; a rescheduling fee may apply

We understand that extraordinary circumstances arise. We will always endeavour to work with clients in good faith.

6. Client Responsibilities

By engaging our services, the Client agrees to:

• Provide accurate information about the venue, guests, and event requirements
• Ensure that our team has safe and timely access to the venue for setup and teardown
• Obtain any necessary permissions or consents for our team to be present at and operate within the venue
• Inform us of any known allergies, medical conditions, physical limitations, or sensitivities among guests that may affect their participation in the experience
• Ensure that the physical environment is reasonably safe for our team and equipment
• Maintain the confidentiality of any narrative, puzzle, or story elements to preserve the experience for other potential guests

7. Venue Access and Property

Our team will treat your home and property with the utmost respect and care. We are committed to leaving your venue in the same condition in which we found it following teardown. Any accidental damage caused by our team during setup or teardown will be our responsibility to remedy.

We require reasonable staging access to your venue prior to the event. The specific access schedule and requirements will be outlined in your Service Agreement.

8. Intellectual Property

All narrative scripts, puzzle designs, story concepts, character profiles, game mechanics, and experience structures created by Bespoke Mysteries remain the exclusive intellectual property of Bespoke Mysteries LLC, even when customised for a specific client.

Clients may not reproduce, distribute, share publicly, or commercially exploit any narrative or experience content created for their event without our prior written consent.

We retain the right to reference a completed experience in general terms (e.g., "a private anniversary event for 18 guests in Southlake") for marketing purposes, but we will never disclose specific client details, venue information, addresses, or identifiable personal information without explicit written permission.

9. Photography and Recording

Clients and guests may take personal photographs and videos during the experience for private use. We ask that no images, videos, or detailed descriptions of puzzles, narrative reveals, or technology be shared publicly online, as this may diminish the experience for future clients.

Bespoke Mysteries may request permission to capture select behind-the-scenes content for marketing purposes. This will always be done with the Client's advance written consent, and no images of guests will be used without individual consent.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Bespoke Mysteries LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of a service engagement shall not exceed the total fees paid by the Client for the specific event giving rise to the claim.

We are not responsible for circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, power failures, or other force majeure events. In such cases, we will work with you in good faith to reschedule or provide an appropriate remedy.

11. Indemnification

You agree to indemnify and hold harmless Bespoke Mysteries LLC and its members, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in connection with your breach of these Terms of Service or your Service Agreement.

12. Governing Law and Dispute Resolution

These Terms of Service and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any disputes shall first be subject to good-faith negotiation between the parties. If resolution cannot be reached, disputes shall be submitted to binding arbitration in Dallas County, Texas, under the rules of the American Arbitration Association.

13. Changes to These Terms

We may update these Terms of Service from time to time. The most current version will always be available on our website. By continuing to use our website or services after any changes, you accept the updated terms. We encourage you to review this page periodically.
